1. About these terms

These Terms and Conditions govern your use of www.vitrex.co.za (the "Website"), operated by Lemon Lab (Pty) Ltd t/a Vicinity (registration number 2013/225667/07), owner of the Vitrex™ brand ("Vitrex", "we", "us" or "our"). By accessing or using the Website, you agree to these terms. If you do not agree, please do not use the Website.

These terms apply to the Website only. The supply of products and services is governed by our quotations, order confirmations and standard terms of sale, which take precedence over these terms where they differ.

2. Information on this website

The Website provides general information about Vitrex™ vitreous enamel products, including cubicles, privacy screens, backsplashes and writing surfaces. We take care to keep this information accurate and current, but:

• Product descriptions, specifications, dimensions, finishes and images are provided for general guidance and may change without notice.

• Colours shown on screen, including in the Colour Visualiser, are indicative only. Final colour and finish should be confirmed against a physical sample before you order.

• Technical information does not replace project-specific advice. Architects, specifiers and contractors should confirm suitability for their application with our technical team before specification or installation.

• Prices, where shown, are subject to formal quotation and may exclude VAT, delivery and installation unless stated otherwise.

3. Quotations, specifications and orders

Submitting a specification request, enquiry or contact form through the Website does not create a binding contract. A contract is formed only when Vitrex issues a written quotation and you accept it in writing, or when we confirm your order in writing. Quotations are valid for the period stated on them.

4. Warranty

References on the Website to the 25-Year Surface Warranty are a summary only. The warranty applies to the vitreous enamel surface and is subject to the full warranty terms, including correct installation, use and maintenance in line with Vitrex guidelines. Full warranty terms are available on request. Nothing in these terms limits any rights you have under the Consumer Protection Act 68 of 2008, where that Act applies.

5. Intellectual property

All content on the Website, including the Vitrex™ name and logo, text, product names, photographs, drawings, technical data sheets, brochures, graphics, icons and software, is owned by or licensed to Vitrex and is protected by South African and international intellectual property laws.

You may view, download and print content for your own reference or for specifying Vitrex products on a project. You may not copy, modify, republish, sell or commercially exploit any content, or use the Vitrex™ name or logo, without our prior written permission.

6. Acceptable use

You agree not to:

• Use the Website for any unlawful, fraudulent or harmful purpose.

• Submit false, misleading or impersonated information through any form.

• Attempt to gain unauthorised access to the Website, its servers or any connected system.

• Introduce viruses, malware or any other harmful code.

• Scrape, harvest or extract data from the Website by automated means without our written consent.

7. Third-party links

The Website may link to third-party websites, including those of our partners. We do not control these websites and are not responsible for their content, availability or privacy practices. A link does not mean we endorse the website or its owner.

This does not exclude liability that cannot be excluded by law, including liability for gross negligence or under the Consumer Protection Act where it applies.

You indemnify Vitrex against any claim, loss or cost arising from your breach of these terms or your misuse of the Website.

We process personal information submitted through the Website in line with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

12. Electronic communications

In line with the Electronic Communications and Transactions Act 25 of 2002 (ECTA), you agree that communications we send you electronically, including by email, satisfy any legal requirement that such communications be in writing.

13. Changes to these terms

We may update these terms from time to time. The updated version takes effect when it is published on the Website, and the effective date above will change. Your continued use of the Website means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts for any dispute arising from them. If any provision is found to be invalid or unenforceable, the remaining provisions stay in full effect.
